Waiver and Release Agreement  

          1 HOPE Therapeutic Riding

Under Colorado Law, an equine professional is not liable for an injury to or the death of a  participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 13-21-119, Colorado revised statutes. 

 

I agree to the terms and conditions of the Waiver Release Agreement. I release 1 HOPE Therapeutic trainers, teachers, volunteers, and horse owners from liability and assume all risks while participating in equine activities. Participants assume all risks of liability should injury or death occurs.   

 

I agree that I will not sue and release all directors, officers, agents, employees, and volunteers from and against any and all claims, actions, cause of action, liabilities, suits, expenses (including attorney fees) related to, arising out of, or are in any way connected with my participation, my minor children’s participation, and my guests in this activity including but not limited to, negligence of any kind or nature, whether foreseen, or unforeseen, deriving directly or indirectly out of any damage, loss, injury, paralysis, or death to me, my minor children, my guests, or my property as a result in engaging in these activities or the use of property.

 

Participant and his or her successors, representatives, heirs, assigns hereby exempt and release Heather Weyker and any agents of 1 HOPE Therapeutic Riding from any and all liability, claims, demands, actions or causes of action whatsoever arising out of any damage, loss, injury, or death suffered by the participant as a result of participant's injury or death as a result of the use of a horse or device. Employees, successors, representatives, heirs, and assigns from or for any claim or suit or action by any person arising out of any damage, loss, injury, or death hold 1 HOPE Therapeutic Riding and Heather Weyker harmless.
